CODE OF CONDUCT/ PENALTY GUIDELINE CHART
The list below gives examples of offences but does not include all offences that may occur. These are only guidelines with regards to possible penalties related to the offences listed,
the merits of each case is still of primary importance in determining the penalty.

  1.2 Negligent Loss, Damage or Misuse of Company/ Client Property          
  A. Negligent loss of Company/Client property:            
       When an employee, through carelessness or negligence, loses Company/Client property or is unable to account for it satisfactorily (clothing, equipment, etc) Final Written Warning Dismissal      
    B. Negligent damage to Company/Client property:          
  When an employee causes or allows Company/ Client property in his charge to become damaged through carelessness or negligence Final Written Warning Dismissal      
    C.   Unauthorised use or Misuse of Company/ Client property:            
  When Company/ Client property is used for purposes other than that for which it was intended i.e. Abuse of telephones/ e-mail/ internet/ etc. Final Written Warning Dismissal

  1.4 Unsatisfactory/ Poor Work Performance:

2. Offences relating to illegal industrial action 2.1 Intimidation / victimisation Dismissal        
  2.2 Sabotage:          
  A.  Any wilful or malicious act to interfere with the normal operations of the Company/ Client by damaging any equipment or by causing the disruption of any services necessary to the operation Dismissal        
  B.  Interfering with or the disruption of work schedules, including the organising, aiding and/or abetting of "go-slow", work stoppage, stay away (voluntary absenteeism), strike action or any other sabotage Dismissal        
  C. Tampering with surveillance equipment Dismissal        
  D. Tampering, obstruction, or destruction of evidence Dismissal        
  2.3 Incitement to strike:          
  A. Any action by an employee to incite, persuade or encourage other employees to take illegal industrial action Dismissal

3. Offences relating to misconduct, insubordination or disorderly behaviour 3.1 Misconduct:          
  A.    Signing registers on belhalf of other nurse or using other candidates particulars to sign and out Dismissal

  3.2  Disobedience:          
  A. Insubordination/ Refusal to obey or carry out a lawful instruction given by a person in authority Final Written Warning Dismissal

  3.5  Alcohol or Drug related Offences:

4. Offences relating to theft or fraud 4.1  Bribery or Corruption:          
  Giving or receiving or attempting to give or receive any bribe, or inducing or attempting to induce any person to perform any corrupt act Dismissal        
  4.2  False evidence:          
  A. Deliberately giving or attempting to give untrue, erroneous or misleading information or testimony Dismissal        
   B. Withholding information or evidence Final Written Warning Dismissal      
  4.3  Forgery:          
  A. Falsifying or changing any document with fraudulent     intent, or attempting to do so (e.g. Sick certificate; timesheet; register; etc.) Dismissal        
  B. Unauthorised use of a micros card (e.g someone else's) or micros pin number Dismissal        
  4.4  Collusion:          
   A. Knowledge of / assisting others in/ or attempted  trangression in terms of this code Dismissal

  4.5 Gross Acts of Lying and Dishonesty Dismissal        
  4.6 Theft related offences:          
  A. Unauthorised possession of Company/Client property Dismissal        
  B. Unauthorised removal of Company/Client property Dismissal        
  C. Assisting in the theft or attempted theft of Company/Client property /Collusion Dismissal        
  D. Collaboration with unprocedural selling (kitchen / bar) Dismissal        
  F. Conducting, carrying on, operating or dealing any cheating or thieving game device on the premises. Dismissal        
  4.7 Misappropriation or Embezzlement:          
  B. Borrowing monies from clients/ patients (for personal use)  Dismissal        
  E. Receiving undeclared monies or gifts from clients or patients Final Written Warning Dismissal      
  4.8 Direct or indirect use or offer your time, experience, knowledge and/or information in your position as an employee of the company for personal gain or to prejudice the company Dismissal        
  4.9  Participating in private work during working hours, for personal gain or to prejudice the company Dismissal        
  No meetings of employees may be held on the company's premises outside of normal working hours (but not including lunch time) unless they have first obtained permission from the company Final written warning dismissal      
  4.10 Disclosure of confidential information to competitor, with or without monetary reward Dismissal

5.    Offences relating to the safety of other employees; dherence to safety standards and procedures 5.1 Carrying unauthorised weapons:          
  A.Carrying unauthorised and/or illegal weapons or other dangerous objects whilst on duty Dismissal        
  5.2 Failing to adhere to safety standards and procedures, e.g.,: failing to wear or use protective equipment in designated areas; Dismissal        
  A. failure to report accidents or personal injury sustained at work immediately Dismissal        
  B. Obstruction to or interfering with safety equipment (including fire equipment) Dismissal        
  5.3 Endangering the safety of others and/or company/client property Dismissal        
             
  5.4 Threat of assault/violence          
   A. Violence, whether threatened or actual Dismissal        
6.    Criminal Activity  A. Any proven charge of criminal activity, or any     criminal charge that you are proven to have been found guilty of Dismissal        
  B. Having been arrested for and charged of criminal activity Dismissal        
  C. Having lied about a criminal record on your appliction Dismissal        
   D. Proven guilty of having committed a Criminal Offence whilst in the company’s employ Dismissal        
   E. Facilitating and or promoting prostitution  Dismissal        
7.    Sexual Harassment A.  Any Act of Sexual Harassment Dismissal        
  B.  Any act of a sexual nature during working hours and/ or on site Dismissal        
8.    Abuse of Position A.  Acting outside of the limits of your authority Dismissal        
  B.  Using your position and the power vested in you for purposes other than intended and/ or for personal gain to prejudice the company Dismissal        
9.    Victimisation A. Any form of Victimisation – including after hours and/ or off premises Dismissal
